Hari Keadilan Internasional dan Omnibus Law

karebaindonesia.id – Abstraksi keadilan dalam negara demokrasi seperti Indonesia bisa dilihat melalui hukum tertingginya. Dalam konteks ini Indonesia mempunyai hukum tertinggi yakni Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI 1945). Muatan Konstitusi memang sangat abstrak karena hanya membahas tentang hal-hal yang bersifat universal dan masih membutuhkan aturan di bawahnya sebagai kongkretisasi dari amanat Konstitusi tersebut. Walau demikian, namun tetap saja keadilan masih menjadi tafsir liberal dalam kehidupan masyarakat Indonesia. Definisi keadilan yang begitu sarat akan makna tertentu bahkan berdasarkan kepentingan individu, sehingga menimbulkan dikotomi yang begitu masif. Tentu sebagai masyarakat yang paham tentang konsepsi keadilan, dalam mencerna setiap pemaknaan harus mendasarkan pada argumentasi ilmiah. Serta menghindarkan diri dari anasir-anasir kepentingan subjektif semata. Karena hal itu akan berdampak pada kehidupan nyata (das sein).

Momentum Hari Keadilan Internasional (World Day for International Justice) yang jatuh pada 17 Juli 2020, patut dimaknai bahwa di masa lalu terdapat suatu peristiwa yang menyayat keadilan Masyarakat Internasional. Cikal bakal dari peringatan Hari Keadilan Internasional itu sendiri adalah tanggal 17 Juli 1998, perwakilan 148 negara menghadiri pertemuan diplomatik di Roma, Italia. Untuk membahas tentang masalah internasional yang sangat mendesak kejahatan internasional. Kejahatan yang kerap terjadi 30 tahun yang lalu ini adalah kejahatan luar biasa seperti kejahatan perang, genosida, serta kejahatan kemanusiaan lainnya. Hasil dari pertemuan tersebut adalah diadopsinya Statuta Roma sebuah traktat (perjanjian) yang menjabarkan bentuk-bentuk kejahatan internasional, sekaligus mandat untuk mendirikan Mahkamah Pidana Internasional (International Criminal Court).

Pada Statuta Roma 1998 tersebut membagi kejahatan dalam 4 kategori. Antara lain kejahatan genosida (pembunuhan massal), kejahatan kemanusiaan, kejahatan perang, dan agresi. Seluruh kategori tersebut akan diperadilankan pada Mahkamaha Pidana Internasional. Perlu juga dipahami bahwa Statuta Roma bersifat mengikat, namun terdapat batasan keberlakuan dalam beberapa klausul. Yakni, Mahkamah Pidana Internasional hanya dapat melakukan investigasi dan proses peradilan terhadap negara yang secara legal meratifikasi Statuta Roma. Serta proses investigasi dan peradilan hanya dapat dilakukan oleh Mahkamah Pidana Internasional bilamana negara terkait tidak dapat, atau tidak mau melakukan proses investigasi dan peradilan (Sumber: https://pkbi.or.id/). Akan tetapi, pada intinya Statuta Roma ini hanyalah sebuah bukti legal bahwa di masa lampau telah terjadi penindasan terhadap nilai keadilan dan kemanusiaan pada Masyarakat Internasional.

Memang pelik persoalan keadilan bagi seluruh penghuni jagat raya ini. Bahkan banyak ahli berdebat tentang apa itu keadilan yang sebenarnya. Menurut A.L. Goodhart, pada umumnya diterima bahwa inti dari ide keadilan adalah to render to each man what is his due (memberikan kepada setiap orang apa yang semestinya). Pandangan yang serupa disampaikan oleh J.P. Plamenatz yang merumuskan keadilan dengan pengertian giving every man his due, and the setting, either by compensating the victim of wrong or by punishing the doer of it (memberikan setiap orang apa yang semestinya, dan membenarkan kesalahan baik dengan memberikan ganti rugi kepada korban maupun dengan memberikan hukuman dari kesalahan itu).

Murtadha Muthahhari dalam bukunya “Keadilan Ilahi: Asas Pandangan-Dunia Islam”, menjabarkan keadilan dengan membaginya dalam 4 pembahasan. Yakni:

Pertama, Keseimbangan. Keadilan dalam arti pada konteks ini ialah keadaan yang seimbang. Dalam sebuah sistem atau himpunan yang memiliki beragam bagian yang dibentuk untuk tujuan tertentu, maka seharusnya ada sejumlah syarat, seperti ukuran yang tepat pada setiap bagian dan pola kaitan antarbagian tersebut. Dengan terhimpunnya syarat-syarat tersebut. Himpunan tersebut dapat bertahan memberikan pengaruh yang diharapkan darinya dan memenuhi tugas yang telah diletakkan kepadanya.

Kedua, Persamaan dan Nondiskriminasi. Pengertian keadilan dalam konteks ini ialah persamaan dan penafsiran terhadap diskriminasi dalam bentuk apapun. Keadilan dalam pengertian ini ialah sama dengan persamaan. Definisi keadilan dalam hal keniscayaan tidak terjaganya beragam kelauakan yang berbeda-beda dan memandang segala sesuatu dan semua orang secara sama rata, maka identik dengan kezaliman itu sendiri. Ketika memberikan kepada semua orang secara sama rata dianggap sebagai sebuah keadilan, maka tidak memberikan kepada semua orang secara sama rata juga dipandangan sebagai keadilan.

Ketiga, Pemberian Hak Kepada yang Berhak. Pada konteks ini, keadilan diartikan sebagai upaya pemeliharaan hak-hak individu dan pemberian hak kepada setiap objek yang layak menerimanya. Dalam pemberian hak kepada setiap objek yang layak menerimanya. Pada pengertian ini, keadilan diartikan sebagai keadilan sosial yaitu keadilan yang harus dihormati didalam hukum manusia dan setiap individu benar-benar harus berjuang untuk menegakkannya. Landasan keadilan pada aspek ini setidaknya ada dua yaitu pertama, hak dan prioritas yakni adanya berbagai hak dan prioritas sebagai individu bila kita bandingkan dengan sebagian yang lain. Kemudian kedua, yakni karakter khas manusia yang tercipta dalam bentuk yang dengannya manusia menggunakan sejumlah ide tertentu sebagai alat kerja, sehingga dengan perantaraan alat kerja tersebut manusia dapat mencapai tujuan-tujuannya.

Keempat, Pelimpahan Wujud Berdasarkan Tingkat dan Kelayakan. Pada aspek ini, keadilan memiliki pengertian sebagai tindakan memelihara kelayakan dalam pelimpahan wujud, dan tidak mencegah limpahan dan rahmat pada saat kemungkinan untuk mewujud dan menyempurna pada suatu itu telah tersedia. Wujud disini diartikan sebagai sesuatu hal yang berbentuk nyata dalam aspek pemberiannya kepada tiap-tiap manusia. Kontestasi keadilan pada rana ini ialah pelimpahannya secara konkret secara komprehensif dan layak sesuai tingkatan.

Bila melihat penjelasan di atas, maka terngiang dipikiran kita tentang sebuah peraturan yang amat kental dalam memperjuangkan keadilan bagi seluruh rakyat Indonesia dalam konteks pemenuhan hak. Adalah Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia (UU HAM) yang menjadi UU pamungkas bagi kalangan aktivis hingga hari ini. Tak sekalipun direvisi oleh para penguasa. Karena di dalamnya terdapat jaminan hak untuk mengeluarkan pendapat dimuka umum. Hal itu relevan dengan ketentuan Pasal 28E UUD NRI 1945 yang berbunyi, “Setiap orang berhak atas kebebasan berserikat, berkumpul, dan mengeluarkan pendapat”. Dalam hal menyampaikan pendapat ini, negara telah menjamin perlindungannya melalui Pasal 33 ayat (1) UU HAM yang berbunyi, “Setiap orang berhak untuk bebas dari penyiksaan, penghukuman atau perlakuan yang kejam, tidak manusiawi, merendahkan derajat dan martabat kemanusiaannya.” Lebih lanjut dalam Pasal 34 UU HAM, termaktub ketentuan bahwa “Setiap orang tidak boleh ditangkap, dittahan, disiksa, dikucilkan, diasingkan, atau dibuang secara sewenag-wenang.”

Bila kita melihat fenomena hari ini terdapat suatu fakta yang nyata bahwa penegakan HAM dan keadilan di Indonesia masih mengalami suatu disorientasi. Karena banyak kasus justru mereka yang bersuara memperoleh tindakan represif dari oknum Aparat Penegak Hukum pada saat menyampaikan pandangannya di muka umum. Sebagai contoh, dari data yang diberikan oleh Yayasan Lembaga Bantuan Hukum Indonesia (YLBHI), setidaknya terdapat 42 orang meninggal dunia sepanjang bulan September 2019. Rinciannya yakni demo 24 September 2019 yang bertajuk ‘Reformasi Dikorupsi’ terdapat 3 (tiga) orang mahasiswa meninggal dunia tanpa keterangan resmi. Demonstrasi 26 September 2019 bertajuk ‘Reformasi Dikorupsi’ menyebabkan 2 (dua) orang meninggal dunia di Kendari akibat luka tembak. Dan aksi anti rasisme di Wamena dan Jayapura pada 23-28 September 2019 memakan korban jiwa hingga 37 orang meninggal dunia tanpa informasi yang resmi pula (Sumber: https://www.bbc.com/).

Fakta terbaru yang terjadi pada 16 Juli 2020 di mana sekelompok aktivis melakukan demonstrasi dengan semangat penolakan terhadap Rancangan Undang-Undang Cipta Kerja (Omnibus Law) juga merasakan tindakan represif tersebut. Seperti data dari Lembaga Bantuan Hukum Bandung (LBH Bandung), bahwa telah terjadi penangkapan secara sewenang-wenang terhadap massa yang hendak bergabung dalam Aliansi Masyarakat Menggugat (Alarm). Alarm adalah salah satu kelompok gerakan yang akan melakukan demonstrasi penolakan RUU Cipta Kerja. Dalam temuan LBH Bandung, memberikan sebuah data bahwa aparat melakukan penghadangan, penyisiran, penangkapan sewenang-wenang, pemukulan, dan interogasi terhadap massa, dan merampas perlengkapan aksi sampai kepada perampasan barang pribadi. Tindakan-tindakan itu terjadi sebelum masa melakukan demonstrasi. Pembubaran dan penyisiran dilakukan beberapa titik, bahkan pemeriksaan dilakukan secara acak terhadap masyarakat yang mengenakan baju hitam (Sumber: https://www.lbhbandung.or.id/).

Jika hal tersebut merupakan kebenaran, maka negara ini telah lalai dengan peraturan yang dibuatnya sendiri. Sedangkan masyarakat dituntut patuh terhadap hukum. Bagaimana mungkin alat perlengkapan negara yang seharusnya menjadi figur hukum justru tidak memberi contoh yang layak ditiru. Terlebih-lebih terhadap mereka yang hendak menyuarakan aspirasinya di depan umum.

Seperti yang diketahui, bahwa RUU Cipta Kerja ini menuai banyak polemik dikalangan akademisi dan masyarakat umum. Karena banyaknya ketentuan yang tidak mencerminkan aspirasi mereka. Beberapa catatan penulis terkait RUU Cipta Kerja ini ialah bahwa RUU Cipta Kerja akan merampingkan sekitar 79 undang-undang dan 1.239 pasal menjadi 15 bab dan 174 pasal yang mencakup 11 klaster dari 31 Kementerian dan lembaga terkait yaitu penyederhanaan perizinan, persyaratan investasi, ketenagakerjaan, kemudahan, pemberdayaan dan perlindungan UMKM, kemudahaan berusaha, dukungan riset dan inovasi, administrasi pemerintahan, pengenaan sanksi, pengadaan lahan, investasi dan proyek pemerintah, serta kawasan ekonomi.

Hal yang menjadi polemik adalah salah satunya dihilangkannya frasa “tanpa perlu pembuktian unsur kesalahan” dalam Pasal 88 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UU PPLH). Awalnya Pasal 88 UU PPLH berbunyi “Setiap orang yang tindakannya, usahanya, dan/atau kegiatannya menggunakan B3, menghasilkan dan/atau mengelola limbah B3, dan/atau yang menimbulkan ancaman serius terhadap lingkungan hidup bertanggung jawab mutlak atas kerugian yang terjadi tanpa perlu pembuktian unsur kesalahan.” Tetapi dalam RUU Cipta Kerja Pasal 88 UU PPLH diubah menjadi “Setiap orang yang tindakannya, usahanya, dan/atau kegiatannya menggunakan B3, menghasilkan dan/atau mengelola limbah B3, dan/atau yang menimbulkan ancaman serius terhadap lingkungan hidup bertanggung jawab mutlak atas kerugian yang terjadi dari usaha dan/atau kegiatannya”. Implikasinya adalah regulasi tersebut dapat menimbulkan kelemahan dalam penegakan hukum bagi pelaku perusak lingkungan hidup. Selain itu, efek penjeraan dan menakut-nakuti pun hilang bagi para pelaku tindak pidana lingkungan.

Selanjutnya, yaitu ditambahkannya sanksi administratif bagi pelanggar baku mutu lingkungan hidup berupa baku mutu udara ambien, air dan air laut pada Pasal 98 ayat (1) UU PPLH. Awalnya Pasal 98 ayat (1) UU PPLH berbunyi “Setiap orang yang dengan sengaja melakukan perbuatan yang mengakibatkan dilampauinya baku mutu udara ambien, baku mutu air, baku mutu air laut, atau kriteria baku kerusakan lingkungan hidup, dipidana dengan pidana penjara paling singkat 3 (tiga) tahun dan paling lama 10 (sepuluh) tahun dan denda paling sedikit Rp3.000.000.000,00 (tiga miliar rupiah) dan paling banyak Rp10.000.000.000,00 (sepuluh miliar rupiah)”. Tetapi dalam RUU Cipta Kerja Pasal 98 ayat (1) UU PPLH diubah menjadi “Setiap orang yang dengan sengaja melakukan perbuatan yang mengakibatkan dilampauinya baku mutu udara ambien, baku mutu air, baku mutu air laut, atau kriteria baku kerusakan lingkungan hidup dikenai sanksi administratif berupa denda paling sedikit Rp3.000.000.000,00 (tiga miliar rupiah) dan paling banyak Rp10.000.000.000,00 (sepuluh miliar rupiah).” Implikasinya adalah terdapat kelonggaran yang luar biasa bagi pelaku pelanggaran baku mutu lingkungan hidup, bahkan ketentuan tersebut cenderung lebih pragmatis dan tidak memberikan efek jera bagi pelaku. Sudah seharusnya sanksi pidana merupakan yang utama diterakan (primum remidium) bagi pelaku pelanggar baku mutu lingkungan hidup sebagaimana asas keserasian dan keseimbangan dalam UU PPLH.

Dihapusnya hak publik untuk melakukan gugatan administratif melalui pengujian terhadap izin lingkungan dan/atau izin usaha melalui Pengadilan Tata Usaha Negara (PTUN) pada Pasal 93 UU PPLH. Sebagaimana diketahui, bunyi Pasal 93 UU PPLH yaitu “Setiap orang dapat mengajukan gugatan terhadap keputusan tata usaha negara”. Gugatan tersebut menurut ketentuan dalam UU PPLH dapat dilakukan apabila badan atau pejabat tata usaha negara menerbitkan izin lingkungan kepada usaha dan/atau kegiatan yang wajib amdal tetapi tidak dilengkapi dengan dokumen amdal, badan atau pejabat tata usaha negara menerbitkan izin lingkungan kepada kegiatan yang wajib UKL-UPL, tetapi tidak dilengkapi dengan dokumen UKLUPL, dan/atau badan atau pejabat tata usaha negara yang menerbitkan izin usaha dan/atau kegiatan yang tidak dilengkapi dengan izin lingkungan. Namun di dalam RUU Cipta Kerja ketentuan Pasal 93 UU PPLH dihapuskan. Hal ini tentunya bertentangan dengan asas partisipatif yang terdapat dalam UU PPLH, serta menghilangkan peran masyarakat dalam ikut serta melindungi lingkungan hidup.

RUU Cipta Kerja juga tidak memperhatikan hierarki peraturan perundang-undangan. Pasal 170 ayat (1), (2) dan (3) secara jelas menjelaskan bahwa “Dalam rangka percepatan pelaksanaan kebijakan strategis cipta kerja sebagaimana dimaksud dalam Pasal 4 ayat (1), berdasarkan Undang-Undang ini Pemerintah Pusat berwenang mengubah ketentuan dalam Undang-Undang ini dan/atau mengubah ketentuan dalam Undang-Undang yang tidak diubah dalam Undang-Undang ini.” Lebih lanjut diterangkan pula bahwa “Perubahan ketentuan sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.” Implikasi dari ketentuan tersebut adalah melanggar ketentuan dalam Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-undangan yang secara tegas termaktub bahwa Peraturan Pemerintah (PP) berada di bawah undang-undang. Dengan demikian PP tidak dapat membatalkan ataupun mengubah ketentuan yang ada dalam undang-undang, sebab PP adalah peraturan pelaksana dari undang-undang itu sendiri.

Itulah beberapa polemik yang terjadi di masyarakat terkait RUU Cipta Kerja (Omnibus Law). Walaupun secara konsep Omnibus Law adalah metode pembentukan peraturan perundang-undangan yang cukup ideal. Tetapi substansinya juga harus diperhatikan lebih dalam lagi. Karena kepentingan publik taruhannya. Selain aspek kemanusiaan, terdapat banyak aspek yang harus diperhatikan salah satunya adalah aspek keadilan ekologis. Kesehatan lingkungan bisa terwujud bilamana aktivitas tambang atau penggunaan hutan lindung dikurangi. Jangan sampai Pemerintah memudahkan perizinan investor melalui Omnibus Law ini justru merugikan bangsa sendiri. Penguasa harus selalu dikontrol dan diingatkan bahwa kepentingan publik di atas segala-galanya. Seperti adagium hukum “solus publica suprema lex” (kepentingan publik di atas segala-galanya termasuk di atas undang-undang).

Apapun kebijakan yang diambil, sang penguasa harus tunduk pada aspirasi masyarakatnya. Apatah lagi hampir seluruh elemen masyarakat menolak RUU Cipta Kerja, di samping RUU lainnya seperti RUU Haluan Ideologi Pancasila, RUU Penghapusan Kekerasan Seksual. Dari polemik ini harusnya Pemerintah dan Dewan Perwakilan Rakyat bisa mengambil keputusan untuk menolak melanjutkan pembahasan RUU tersebut. Terlebih lagi Indonesia sedang dilanda Pandemi Corona Virus Disease 2019 (Covid-19). Penguasa mestinya fokus mengatasi virus tersebut, bukan malah membahas rancangan peraturan yang justru memperkeruh suasana. Dengan demikian keadilan akan senantiasa tegak, dan HAM terpenuhi secara komprehensif. Intinya, keadilan harus senantiasa dijadikan dasar pijakan pengambilan kebijakan. Karena keadilan adalah to render to each man what is his due (memberikan kepada setiap orang apa yang semestinya).[]
