Mahfud: Berlebihan Jika RKUHP Harus Dibahas Setengah Abad

Jakarta, karebaindonesia.id – Menteri Koordinator Bidang Politik, Hukum dan Keamanan (Menko Polhukam) Mahfud MD menilai berlebihan apabila Rancangan Kitab Undang-undang Hukum Pidana (RKUHP) harus dibahas hingga setengah abad.

RKUHP telah dibahas sejak 1960-an. Namun hingga kini RKUHP belum juga mencapai kata sepakat hingga bisa menjadi alat hukum yang bisa diterapkan di Indonesia. Sementara KUHP telah berlaku sejak masa penjajahan Belanda.

Mahfud tak menampik, RKUHP memang mesti dibahas secara spesifik dan mendalam. Pembahasannya pun tak bisa dilakukan secara terburu-buru. Namun, kata dia, bukan berarti harus dibahas hingga 50 tahun lebih.

“Bicarakan pelan-pelan saja. Tapi kalau pelan-pelan lebih 50 tahun, berlebihan,” kata Mahfud dalam diskusi yang digelar Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham) berkaitan dengan RKUHP, Senin (14/6).

Saat ini, kata Mahfud, perdebatan soal RKUHP harus segera diakhiri. Semua pihak harus menyudahi perdebatan berkepanjangan terkait aturan-aturan yang ada di RKUHP ini.

Nantinya, setelah perdebatan disudahi dan muncul kata sepakat, maka akan melahirkan kesepakatan demokratis yang dapat menampung kepentingan semua pihak.

“Nah, dalam resultante KUHP ini kita sedang usahakan resultante yang demokratis, di mana semua didengar,” kata Mahfud.

Dia pun mengajak agar semua pihak bisa menyepakati resultante baru guna mengakhiri perdebatan panjang. Lagi pula, kata dia, jika hasilnya nanti inkonstitusional, hal itu bisa ditinjau ulang.

“Nanti ada MK, ada legislative review lagi, tidak mungkin kita menutup terhadap legislative review, ini berlaku selamanya tidak bisa diubah, tidak mungkin,” kata dia.

DPR bersama pemerintah bisa membahas dan mengesahkan RKUHP pada tahun ini. Daftar RUU dalam program legislasi nasional (Prolegnas) bisa diubah meski sudah ditetapkan.

Peneliti Forum Masyarakat Peduli Parlemen Indonesia (Formappi) Lucius Karus mengatakan RKUHP bisa dimasukkan dalam prolegnas 2021 di tengah tahun. Oleh karena itu, RKHUP masih memungkinkan untuk dibahas dan disahkan tahun ini.
