Lingkar Dakwah Mahasiswa Indonesia (LIDMI) kali ini merespon diskursus berkenaan dengan Putusan Mahkamah Agung Terkait dengan PKPU Pasal 3 Ayat (7) dengan mengadakan “Webinar Yuris Nasional” dengan tema “Quo Vadis Putusan MA : Kebuntuan Presidential Thresold dan Landmark Pemilu yang Jujur dan Adil” yang akan menghadirkan lima tokoh Nasional yaitu, Dr. K.H. Muh. Zaitun Rasmin, M.A. (Wasekjen MUI Pusat, Ketua Ulama dan Dai Asia Tenggara dan Ketua Umum Ormas Wahdah Islamiyah), Prof. Dr. Denny Indrayana, S.H., L. LM., Ph.D. (Wakil Menteri Hukum dan Ham 2011 – 2014 dan Pakar Hukum Tata Negara), Prof. Dr. Hamdan Zoelva, S.H., M.H. (Ketua Mahkamah Konstitusi RI 2013 – 2015 dan Pakar Hukum Tata Negara), Dr. Margarito Kamis, S.H., M.Hum. (Pakar Hukum Tata Negara), Dr. Fahri Bachmid, S.H., M.H. (Pakar Hukum Tata Negara). Kegiatan ini dijadwalkan pada hari Rabu, 15 Juli 2020 pukul 19. 30 Waktu Indonesia Tengah secara virtual dengan menggunakan aplikasi Zoom.
Asrullah sebagai ketua Departemen Humas PP LIDMI mengatakan diskursus ini penting untuk didiskusikan mengingat Putusan Mahkamah Agung (MA) RI Perihal Pengujian Pasal 3 Ayat (7) Peraturan Komisi Pemilihan Umum (PKPU) Tentang Penetapan Pasangan Calon Terpilih, Penetapan Perolehan Kursi dan Penetapan Calon Terpilih dalam Pemilihan Umum telah diputuskan oleh Mahkamah Agung sebagaimana yang tertuang Pada Putusan No. 44 P/HUM/2019 yang menuai polemik dan diskursus sistemik ketatanegaraan di masyarakat luas dalam kehidupan berbangsa dan bernegara.
Selain dari Putusan Mahkamah Agung yang menyatakan Pasal 3 Ayat (7) PKPU Bertentangan Dengan UU Pemilu dan UUD NRI 1945, pandangan mayoritas akademisi juga berpandangan bahwa Putusan Mahkamah Agung ini tidak sekadar Penganuliran Pasal 3 Ayat (7) tetapi ada problem yang menjadi hulu dari realitas pemilu ke pemilu kita, yakni tidak lepas dari adanya tembok penjegal untuk melahirkan banyak calon pemimpin bangsa (Presidential Threshold). Kemudian ihwal yang kedua, falsafah pemilu dalam UUD NRI 1945 dalam Promulgasi Pemilu mengharuskan dijalankan diatas prinsip jujur dan adil sebagai marwah dan moralitas Pemilu.
“Kegiatan ini diharapkan mampu untuk menggalang suara dan menyatukan presepsi terkait kebuntuan Presidential Threshold yang mana mayoritas ahli hukum tata negara berpendapat bahwa ihwal tersebut bertentangan dengan UUD 1945, sehingga dalam syarat pencalonan presiden, setiap parpol dapat mengajukan calonnya sebagimana yang telah diatur dalam UUD 1945 Pasal 6A ayat 2, sehingga dalam kontestasi pemilu masyarakat disugukan alternatif pilihan calon pemimpin bangsa (calon presiden dan Wakil Presiden) yang lebih banyak dan representatif dengan cita moral dan keinginan masyarakat Indonesia.” Ujar Achmad Qadry Ashary selaku ketua panitia.[]
